3. Confidentiality and Proprietary Information


We recognize that certain information shared by our clients is proprietary and confidential. Confidential or proprietary information encompasses written, printed, graphic, and electronic materials provided by the client, business and marketing plans, customer information, operating procedures, trade secrets, design formulas, processes, and any information the client reasonably endeavors to keep secret. Data collected from employees during assessments and training activities is treated with strict confidentiality. We commit not to disclose or misuse this information, either during or after the term of engagement, except as necessary to provide our services.


4. Data Handling, Retention, and Research Use


Collected data is aggregated and anonymized in our reports to the client. The data will be retained for one year following the completion of services to address any follow-up inquiries from the client. After this period, data is securely destroyed, and data-specific information will not be repurposed for research or other uses without express client approval.


In select cases, and only with the client’s approval and agreement from relevant parties, data may be used for academic research, including potential publication in peer-reviewed journals. All such research will adhere to ethical research practices, including coordination with a university Institutional Review Board (IRB) to ensure compliance with confidentiality and ethical standards.


5. Training Materials and Intellectual Property


Recordings, slides, and other training materials provided to clients are intended solely for internal review and must not be used commercially or shared outside the client’s organization. Prasad & Associates, LLC retains the right to reuse, modify, and repurpose general training materials for future engagements, excluding any confidential or proprietary information specific to the client. Final reports and summaries based on analyses are accessible for client use but exclude raw data from employee assessments, which remains proprietary to Prasad & Associates, LLC.


6. Security Measures


We implement rigorous security practices to safeguard data integrity, including industry-standard physical, electronic, and administrative safeguards to prevent unauthorized access, maintain data accuracy, and ensure the correct use of information.


7. Rights and Remedies


In the event of a breach or threatened breach of confidentiality, we acknowledge that our clients are entitled to seek equitable relief, such as an injunction, in addition to any other rights available under the law.
